Supreme Court Second Amendment Update 12-6-2024
Today, December 6, 2024, SCOTUS granted several cert petitions after its weekly conference, the conference where the justices decide which cert petitions the Court will grant.
Unfortunately, Wilson v. Hawaii was not one of those petitions. Today was the ninth time the petition had been voted on in a conference.
After nine conference votes without a grant of the petition, the most likely outcome is that the petition will be denied. The second most likely outcome is that the petition will be denied with one or more justices either dissenting from the denial of cert or otherwise commenting on the denial of cert. The petition could be scheduled for another conference. The petition could be granted, or the petition could be disposed of with a GVR (Grant-Vacate-Remand), or the least likely outcome, instead of a grant to decide the case on the merits, the justices could issue a per curiam (unsigned opinion).
SCOTUS will issue its Orders List on Monday at 9:30 AM ET. If Wilson v. Hawaii does not appear on the list, we will know it has survived another conference.

The application is misleading because it mentions the state's prohibition on issuing concealed carry permits to those under the age of 21 even though the court of appeals did not invalidate that law. On May 1, 2024, the district court judge altered his judgment and limited it to enjoining the law prohibiting Open Carry.
